It has come to my attention that there is a bill in session that is going to take away your right to traffic school in Colorado, under the guise of just removing the requirement that DOR not be required to evaluate the effectiveness of these improvement schools any more. However, the legislators sneakily struck language REQUIRING the court to offer this option to reduce or dismiss your citation if you havent been convicted of a motor vehicle related statute within the last 18 months, the specific language being stricken is: or, if the defendant has not been convicted of a violation of this article or any other law regulating the operation of motor vehicles within the last eighteen months, the court SHALL offer the defendant an opportunity This is IMPORTANT language, with it stricken, the court MAY offer the opportunity, they MAY also NOT offer it. Currently Arapahoe County Government, Colorado refuses to offer this to defendants charged with traffic infractions, when I showed that they were REQUIRED by statute, instead of offering it, they plea bargained me to a 0 point seat belt ticket which was cheaper and has no points anyways, its my belief this bill is an attempt to keep that policy in place - I have telephone recordings of court officials stating it is the policy of Arapahoe County not to offer this option on infractions, in spite of the fact that the statute is clear and requires this. This is an essential defense that should be offered to first time and occasional offenders who have never dealt with traffic court.
