Suzanne Daly Today at 00:57 This is a letter that Dermot Murphy from the National Citizens Movement, and myself, drew up for those people who have filled in their application packs for Irish Water, and now want to change their minds and no longer want to be a customer of Irish Water. Please feel free to copy this and send if you are one of these people. Many thanks Dear Irish Water Some time ago I sent in an Application pack to your Office, to become a Customer with Irish Water. I did this solely on the reports I seen in a Tabloid Newspaper, and on the news, that Wicklow Co council would evict tenants who did not register with your company. Wicklow Co council has since stated that this was a mistake, and that they had no Legal right to evict anyone who did not register. Therefore, as in Article 40 of our constitution, that states we both stand equal before the Law, I would like to say that I too made a mistake, and registered with you because of Wicklow Co. Councils actions. After further investigations I discovered that under the Sales of Goods Act 1893 and the Sales of Goods Act 1980, no contract is valid or legal unless the ‘customer’ has all the relevant terms and conditions presented to them before signing any documentation. Your company has clearly failed to do this as I was unaware of your obscene call out charges and charges to fix leaks should they occur, plus Im sure lots of other terms that will be forthcoming. The Irish Government themselves are breaking 5 EU laws, namely, the two mentioned above, and The Consumer Protection Act 2007, The European Competition Act 2007, The European Competitions Treaty, Articles 82 + 86, where it is illegal for any government or private company to operate a revenue generating monopoly. The Irish Laws that are being broken consist of The Companies Amendment Act 2009, The Companies Amendment Bill 2012, The Competition Amendment Bill 2011, The Legal Services Regulations 2011 and lastly The Legal Services Ombudsman Bill, which all state that people have a right to choice. Also under The Non- Fatal Offences Against The Persons Act, Section 11 (d) it is an offence to intimidate by a false declaration, known it to be false. Therefore, I would like to Rescind my offer of Contract, and do not wish to be a Customer with your Company. Please return my Application pack to me, and destroy any copies you may have made, and remove any of my personal data, including my PPS No. that you may have entered on your database.
