Itama po natin! By: Ben Lou Q: The collection agency took all my money in my bank account. How can I stop them? A: The sad and honest truth is you can’t. Why do we always let our problems get to the extremely severe situation before we act on it? If this was going to happen, it would have been better to file bankruptcy instead of letting them just take your money without your approval but we should start from the beginning. There would have been a time when you stopped paying your debts and when this happened, it would have been a good time to call. Instead nothing was done and it went from creditor to a collector(Collection Agency). At this point, help would still have been available but again, nothing was done. Then, the collector decided to sue and so it went from the collection agency to an attorney who sent a warning letter that if they did not hear from you in 30 days, they proceed with a lawsuit. Again, nothing was done. So they filed a suit and you were served a summons to file an answer in 20 or 30 days, and still nothing was done. Since, there was no answer filed, they automatically won the suit by default which then gives them the right to garnish wages, levy an account in a financial institution, or attach a lien on properties under your name. This means that they found out you had a bank account and decided to proceed by means of levy. That’s why they took the money from your bank account. If you run through this whole scenario I just mentioned, I believe there were at least 4 times that action could have been taken to not let this situation get this bad.
