It has been brought to our attention that you have been advertising your gym using the CrossFit trademark (https://facebook/1470929746468260/photos/pcb.1587532531474647/1587531904808043/?type=1&theater) As you may or may not be aware, CROSSFIT is an internationally registered trademark in Classes 41, 28, 25, and 16 (1184215). As the owner of the licensed marks, CrossFit, Inc. has exclusive rights to use of the CrossFit trademark. A consumer has the reasonable expectation that any gym being advertised with the CrossFit brand name is associated or affiliated with CrossFit, Inc. Since you are advertising your gym using the CrossFit trademark, you are causing consumers to falsely believe that your gym is associated with CrossFit, Inc. when it is not. This constitutes trademark infringement and is actionable under trademark law. You must stop advertising CrossFit, or any confusingly similar version of CrossFit on your website and at any facility. You also must delete any or all mention of CrossFit from any advertising, social media, like Facebook, Twitter, etc. If you decide to change the name, I must emphasize the importance of changing the name of CrossFit to something that is not similar to our brand name. Using confusingly similar versions of our brand name like XFIT and CROSSFITNESS is just like using the name CrossFit, and is illegal. You may not advertise or tell clients (word-of-mouth advertising) that your gym is a CrossFit gym. I will review your website in five days to see that all mention of CrossFit, or any confusingly similar version of CrossFit is removed from your website and social media pages. Since you are infringing on our brand, the burden is on you to research and cancel all advertising of our brand name. Please send me a confirmation e-mail once you have made these changes.
