Judge Blaine P. Cannon just cant let the prosecutor in him go. Twice now as a judge, Ive witnessed Cannon jump in the middle of things and assume the position of a prosecutor during a hearing or court trial. At a preliminary hearing the prosecutor and the defense attorney ask the states witnesses questions to determine if there is probable cause to bind the case over to district court. After both sides have rested, and closing statements have been made, the state always getting the last word, the presiding judge will make some comments as to how he arrived at his decision then tells you what he decided. The fact that Cannon jumps in and starts asking one of the states witnesses questions, prior to the prosecution resting, proves he has already made his mind up. Convincing himself you might say. Same thing he did during a court trial. Its his job to listen to arguments and questions being asked of witnesses on both sides then render his decision. He can interject of course should one side need corrected on law or procedure, but to jump in and start arguing with the defense attorney, using statements like in theory attempting to make the defendants look guilty before all evidence has been presented is way out of line. Of course at this preliminary hearing it was easy to tell with his first statement which way he was going to go. Not to mention the fact he jumped in asking questions when the state had a prosecutor sitting right there. Cannon must have felt the prosecutor had left something out. Cannon was a malicious prosecutor for so many years, he just cant let it go. In his acceptance speech he claims to have learned to be fair in all his years of being a prosecutor. Funny thing is the prosecutor is suppose to be fair the whole time. To Seek The Truth, is the prosecutors first and foremost obligation. A case requiring him to switch complainants, contents of complaint and witnesses against us proves he is nothing about truth, he wasnt then, he isnt now.
