Judge James P. Smith dismissed my lawsuit against Riviera Fitness with prejudice and for failure to prosecute that allowed the defendant to raise a res judicata defense against a subsequent civil complaint back in 2008. Currently, judge Smith used the same failure to prosecute tactic in the lawsuit against the Automobile Club Inter-Insurance Exchange et al, including United Towing & Transport LLC and Express Oil Change LLC t avoid ruling on the defendants motions to dismiss pleadings and to open the door for res judicata defenses if another lawsuit is filed. This time though, Im appealing the courts failure to prosecute final order dismissing the case tactic because it cannot be supported by the record, and Ive had it with this court discriminating against Afrikan-American litigants to protect defendant who commit misrepresentation and fraud against consumers.
