(KALA OHANAS UPDATE) THE KALA CASE IS STILL ALIVE!! TO ALL WHO SUPPORT THE KALA OHANA TO REMAIN IN THEIR HOME!!! On Monday June 2nd, 2014 the Kalas and their attorney appeared before Judge Blaine Kobayashi in the District Court of the Second Circuit on the Kala Motion to Reconsider the Summary Judgment Order which the Court had granted to DHHL for a Writ of Possession and Judgment of Possession of the Kala “leasehold property”. Due to the fact that the Court could not find their copy of the Kala motion in their file, because it was filed under the incorrect case number, it was continued to a date to be determined this week. However, since the Kalas original hearing wherein the Judge granted DHHL a Writ of Possession; Attorney Burton D. Gould, Esq. took over the case to help the Kala ohana. Mr. Gould filed a pleading which brings to the Courts attention the fraud and mismanagement of DHHL as the “Trustee” of the Hawaiian Homelands and the facts that the lease was not executed properly and acked sufficient disclosure to protect the Kalas rights as beneficiaries; the loan was not implemented properly (The Rural Development Agency failed to adjust the rate pursuant to the Kalas change of circumstances (which is required in the contract); the house value is far below the appraised value upon which the loan was made pointing to fraud, and possible racketeering charges; and, the title to the property is not free and clear. In fact, Edward P. Kakalia, who was confirmed in an ongoing case Kahoma va. The Heirs of Kanaina, as having ownership interest in Lunalilos Estate, has come forward to contest DHHLs ownership of the lot and leasehold upon which the Kalas reside. Kakalia is a legitimate heir to Kanaina, the natural father of Lunalilo, who the entirety of Lunalilos land was willed to, and to Kahonu, Kanainas nephew; Eseta Kipa, Kanainas daughter, and Queen Kalama, Kanainas sister. The Ahupuaa of Lunalilo LCA 8559-B, includes the Waiehu subdivision of Hawaiian Homelands, and the Kalas and many Hawaiians, reside upon this very land. In 1997 and 1998, the Wailuku Sugar Company deeded the lots upon which the Kalas reside, to DHHL. Kakalia has presented documentation showing that the Wailuku Sugar Companies purported “deeds” are not valid. Finally, Kakalia has graciously deeded his ownership interest in the lot upon which the Kalas reside to Ira and Kellyann Kala and to their heirs and successors forever. Furthermore, the Kalas who didnt know that or how to appeal the cancellation of their Hawaiian Homelands lease have filed an appeal 3 years later with Mr. Gould arguing to the court that the presence of fraud in the lease, loan and house valuation should allow the Kalas to file their appeal at this time. PLEASE COME AND SHOW YOUR SUPPORT FOR THE KALAS AT THE NEXT HEARING !!! THE TIME HAS COME TO TAKE A STAND AND SUPPORT WHAT IS PONO!! KEEP CALLING THE LEGISLATORS AND THE GOVERNOR TO PROTECT THE KALAS!!!
