KAMPALA- Six months after she was arrested in connection with the death of her husband, Ms Jackie Uwera Nsenga, was yesterday produced in court amid tight security by the police. She was charged with murder of Juvenale Nsenga before a closed door court session held in the chambers of Nakawa Chief Magistrate, Ms Sylvia Nabaggala. Heavily deployed armed police officers both in uniform and plain clothes, commanded by deputy director of Criminal Investigations and Intelligence Directorate (CIID), Mr Geoffrey Musana, guarded the court premises in the midmorning session and barred journalists from taking photographs and attending the session. Clad in a black skirt and a blouse with stripes, Ms Uwera was driven in a police pick-up truck to the court cells where she stayed briefly before appearing before the magistrate. She was later driven away in the same police truck to Luzira prison in company of police officers before a remand warrant was prepared by court. She was remanded until August 5, a day to the hearing of an application in which the family of the deceased businessman was seeking for court orders to compel the police to produce Ms Uwera in court to face murder charges. High Court judge Albert Rugadya Atwooki had set today (July 16) for hearing of the application by Nsenga’s brothers; Mr Innocent Bisangwa and Mr Joseph Kananura who had sued Attorney General (AG) to have Ms Uwera produced in court over murder as sanctioned by the Directorate of Public Prosecutions (DPP). The murder charges against Ms Uwera were sanctioned by the DPP, but police had earlier said they had found no evidence of intentional killing. The police have since sought for the advice of the AG. But Nsenga’s brothers had asked the court to direct the DPP to register an indictment of murder in court against Ms Uwera and apply for a production warrant for her. Court heard that the AG, Mr Peter Nyombi, had instituted two committees to have the case resolved out of court. State Attorney Geoffrey Madette told court that the two committees comprising officials from the DPP, the Inspector General of Police and the Director of Civil Litigation required one month to be able to report to court. Nsenga’s family members had alleged that it is the duty of the Force to produce the suspect (Ms Uwera) whom they have detained since February, which is beyond the mandatory 48 hours. On May 28, Mr Madette wrote to the Deputy Registrar of High Court showing that Mr Nyombi was “having personal conduct of the matter regarding the request for legal guidance submitted by Inspector General of Police, Gen Kale Kayihura.” According to an affidavit by Mr David Ndamurani-Ateenyi, a principal State Attorney with the DPP’s office, the case file was on March 15 dispatched to the Criminal Intelligence Investigation Department headquarters with a forwarding letter confirming that there was sufficient and credible evidence in support of the charges. THE CASE Police petitioned the Attorney General to block murder charges against Ms Jackie Uwera. The charges were brought forward by the Director of Public Prosecutions, but police said they had found no evidence of intentional killing against the accused. Ms Uwera knocked her husband dead while driving through the entrance of their home in Bugolobi, a Kampala suburb, in January. The police had since, however, declined to take Ms Uwera to court, insisting that there is no evidence to pin her.
