Governor Muhktar Ramalan Yero, who had last month fired the commissioners with the hope of injecting fresh blood into the state executive council, would have to wait till normalcy return to the House. Our correspondent reliably gathered that Governor Yero had shortlisted the name of his fresh commissioners, but could forward the names to the Assembly for approval because of the crises. LEADERSHIP recalls that 18 of 34 members of Kaduna State House of Assembly announced the removal of their Speaker, Hon. Usman Mua’azu Gangara (Giwa East Constituency), replacing him with Hon. Shehu Tahir (Giwa West), with less than two-thirds majority. Alhaji Mu’azu Usman Gangara, along with15 other members, described the impeachment as illegal, claiming he was still the speaker of the House and that the House was on recess until further notice. LEADERSHIP gathered that the House will need two-thirds majority of the lawmakers for it to approved any request from the governor, however, the 16 members stayed away the House, claiming that they were still on recess. When contacted Dr. Dogara Dary Matoh, the ‘deposed’ deputy speaker, insisted that the House was still under recess until further notice. “The House is still under recess, the 18 members who are attending sittings cannot pass any resolution, they don’t have the two-third majority to approved any governor’s request.” Meanwhile, the conference of speakers of states’ legislatures have wave into the matter by setting up committee to investigate the purported impeachment. Our correspondent learnt that chairman conference of speakers of state legislatures, Hon. Inuwa Garba has constituted a committee to investigate the purported impeachment of Speaker Gangara. Meanwhile, the crises rocking State Assembly has taken a legal dimension, as 16 lawmakers dragged 18 other members to a Kaduna State High Court challenging the legality of the purported impeachment of Speaker Gangara and his deputy, Dr. Dogara Matoh Dary. The court served 18 members of the Assembly, who formed the new leadership of the House under Hon. Shehu Usman Tahir, with originating summons. The originating summons was made available to LEADERSHIP yesterday in Kaduna, contained four issues for determination before the court. The defendants have 21 days to respond to the originating summons from the date of service. The 16 are asking the court to determine: whether there is any provision for the position of “Speaker Protempore” in the constitution, let alone such Speaker Protempore presiding over the purported removal of the Speaker; and whether the 1st to 18th Defendants formed the constitutionality stipulated quorum of 2/3rd majority of all the 34 members of the 19th Defendant which is 23 members of the House for the purpose of the removal of the Speaker . The other two issues are whether the purported removal was valid in regard of section 92 (2) (c) and also whether it is constitutional valid and proper for the first and the 18 defendants to remove the first and second plaintiffs as Speaker and Deputy Speaker respectively.
