Land rights are rights created by the Australian, state or territory governments. > native title arises as a result of the recognition, under Australian common law, of pre-existing Indigenous rights and interests according to traditional laws and customs. < So the Government recognises in common law, the pre-existing traditional laws and customs. So why is that recognition not already being enforced by the Government?
