Legal Mandate of the Sangguniang Bayan The former Senator Aquilino Q. Pimentel brainchild the enactment of Republic Act No. 7160. On October 10, 1991, the Eight Congress of the Philippines passed this law which is otherwise known as the Local Government Code of 1991 that gave birth to local autonomy in the country which also paved way to the formation of the Sangguniang Bayan, the legislative body of the municipality. The Sangguniang Bayan is composed of the Municipal Vice-Mayor as the Presiding Officer, the regular Sangguniang Members, President of the Association of Barangay Captains in the municipality and President of the Sangguniang Kabataan Municipal Federation. Powers, Duties and Functions: 1. Approve ordinances and pass resolutions necessary for efficient and effective municipal government. 2. Generate and maximize the use of resources and revenues for the development plans, program objectives and priorities of the municipality with particular attention to agro-industrial development and countryside growth and progress. 3. Grant franchises, enact ordinances authorizing the issuance of permits or licenses, or enact ordinances levying taxes, fees and charges upon such conditions and for such purposes intended to promote the general welfare of the inhabitants of the municipality. 4. Regulate activities relative to the use of land, buildings and structures within the municipality in order to promote the general welfare. 5. Approve ordinances which shall ensure the efficient and effective delivery of the basic services and facilities. In General – The Sangguniang Bayan may enact ordinances or pass resolutions or appropriate public funds that may cover or refer to the following instances: 1. Social services; 2. Peace and order; 3. Appropriation of funds and passage of municipal budget; 4. Zoning regulations; 5. Regulation of traffic; 6. Water supply; 7. Sewage disposal; 8. Protection of the disabled and elderly; 9. Regulation of maintenance as well as operation of business and sale of products; 10. Adoption of land use plan and reclassification of land; and 11. Grant of loans to other LGUs.
