MAN GETS FINE FOR CAUSING DEATH BY DANGEROUS DRIVING THE Chipata High Court on Tuesday fined a bus driver K1, 500 for causing death by dangerous driving. High Court judge Justin Chashi convicted Smith Mwale after he pleaded guilty to the charge. Facts of the matter were that Mwale on February 27, 2012 whilst driving a Scania Marcopolo bus registration number ABM 3491 caused the death of John Njovu at Mumbi turn-off in Petauke district. Postmortem results revealed that the cause of death was multiple body injuries. In mitigation, senior Legal Aid counsel John Phiri said Mwale was a first offender who readily pleaded guilty without wasting the courts time and resources. Phiri asked the court to humbly look at the manner in which the accident occurred and how the deceased who was cycling changed lanes. He said Mwale was remorseful that life was lost through his driving. Phiri said to show his remorse, Mwale bought a coffin, provided food and transport during Njovus funeral. Judge Chashi said he considered what was said in mitigation and that Mwale was entitled to maximum leniency. He noted that there were no aggravating circumstances in the matter. Judge Chashi said Mwale should pay the fine within 30 days and that K1, 000 would go to the deceaseds estate while K500 would go to the government. He then suspended Mwales driving licence for six months. And judge Chashi also fined Stephen Mubanga K2,000 for causing the death of a Nyimba resident. He said K1,500 would go to the deceaseds estate while K500 would go to the government. Judge Chashi noted that there was an element of speeding on the part of Mubanga and that he did not stop after the accident. He suspended Mubangas driving licence for one year.
