MEDIA STATEMENT FOR IMMEDIATE RELEASE MXOLISI NXASANA DAMAGED THE TRUST SOUTH AFRICANS HAD IN HIM BY MAKING HIS FIRST DECISION IN OFFICE AS NATIONAL DIRECTOR OF PUBLIC PROSECUTION says COPE. Two months ago, after an audit by the South African Police was tabled in parliament, shocking statistics revealed that almost 1500 police officers, including seven high ranking police officers, have criminal records. Yesterday, President Jacob Zuma’s new appointee as NDPP did not waste time to reveal his true colours when he told parliament’s portfolio committee in the morning that he needed more time to consider the Richard Mdluli case, but in the afternoon he told MPs that he filed papers to appeal the court ruling in the Freedom Under Law vs Mdluli matter, just hours after he pleaded for more time to consider his decision. This development is a matter of grave concern to the Congress of the People. In effect, Mxolisi Nxasana is challenging the authority of the courts to correct irregular decisions by his office. By implication this means, should a court in future rule that criminal charges against President Jacob Zuma be reinstated, Nxasanga might challenge same, not only because he appears to view the privileges of prosecution as his birth-right (whether his decision is right or wrong) but also because he now proofed to be out to protect an unsavory character because that is what President Zuma wants. Mxolisi Nxasana did not make a single other decision since he was appointed before he jumped to the defense of President Jacob Zuma’s political ally, Richard Mdluli. The latter stands accused of criminal charges including murder, intimidation, attempted murder, kidnapping, assault with intent to do grievous bodily harm, defeating the ends of justice, fraud, corruption, theft and money laundering. Is Richard Mdluli the type of cop Riah Phiyega wants in the Police? The Congress of the People reserves our right to withdraw our initial support for Mxolisi Nxasana as NDPP. It also appears as if President Jacob Zuma didn’t learn his lesson after the Menzi Simelane fiasco. If matters continue this way, Nxasana’s suitability as NDPP is likely to be questioned sooner rather than later. Issued by: J.J.
