We have obtained convictions in those cases): That is BUT one of two possibilities (the other being that the persons BAC was 0.06 at the time of arrest). Unless you are clairvoyant how could you possibly know? Guess what... You cant and you dont; but your blind and blanket assertion exemplifies the mentality of your (and many other SAOs) office - everyone who drink drives is guilty and should be punished regardless of the facts (which you automatically and default assume to be malum in se (or naturally evil). I do not think that anyone should drink drive ever but I also do not convict everyone who does. The law is the law and unless the facts meet the threshold no crime has been committed. It is unfair, unreasonable and unacceptable for you (Farrah Emami, and all of you ASAs out there) to automatically assume that everyones metabolism is on the downswing, as opposed to the upswing, in every DUI case. Still, you, the folks, know the mentality of LEOs and prosecutors so its up to you to... Be smart: Dont drink and drive, but, if you do, just say NO{thing}, dont blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 1-888-SHARK-8-1, 305-381-8686, 305-798-2220, **ARRESTED, **INJAIL, **HABERLAW, **MIAMILAW or **MIAMIDUI.
