Montgomery Creek murder trial dates set Posted: Saturday, July 26, 2014 2:04 pm By Katie Clontz The case against one of the accused in the Zachery Soots murder has been dismissed, but a judge denied a request to dismiss another. Soots, 23, was found dead near a bridge in Montgomery Creek by Grant City Road April 13. He died from multiple gunshot wounds. Edward H. Thompson, 34, Indianapolis is charged with murder. Melissa York of Fairland and Jessica Duncan of New Whiteland were charged with assisting a criminal. Duncan’s trial is scheduled for Aug. 11 in Henry Circuit Court 1. York’s case was dismissed. Thompson, York and Duncan were allegedly in a tan Chevy Blazer with Soots April 13 when Thompson shot Soots and put his body in the back of the car. York drove the Blazer to the bridge over Montgomery Creek, where Thompson dumped Soots’ body, with help from Duncan, who also served as the lookout, according to court documents. Thompson’s attorney, Mark Stamper, filed a motion to dismiss Thompson’s case because the location of Soots’ murder cannot be specified. A judge ruled that the imprecise location of where Soots was killed did not constitute grounds to dismiss. The court will review Thompson’s bail Aug. 12, but Henry County Prosecutor Joe Bergacs said approval is unlikely. Additionally, Stamper claims Thompson did not have the ability to understand the full meaning of Miranda rights. A hearing on Stamper’s motion to determine whether Thompson’s rights were violated due to Thompson’s alleged inability to understand Miranda rights is scheduled Sept. 16. Stamper also filed a motion to move the case to another county, but that motion is still pending with the court, Bergacs said. A trial originally scheduled for Thompson Aug. 4 was canceled. A new jury trial date had not been set. ....we now have the dates.
