Morning, AG Holder’s remarks about opening a vigorous criminal investigation into the decapitation of journalist James Foley were heartfelt, strong and on point. They were also rendered more powerful by the fact that he did not then run off to play golf on the graveyard. The AG is right that his Justice Department has a vital role to play. If we can extricate or intercept or extract any ISIS activists then federal criminal prosecution is called for absolutely. But I see Foleys torture beheading as more than a crime to be prosecuted. This was an Act of War committed by a de facto state, the Islamic State, against the United States. We must declare war on this de facto state. They have certainly declared war on us.
