My letter to Judge Eric Fancher regarding the pending criminal case against Erick L. Fitzpatrick: The Honorable Eric Fancher, Sr Bessemer Justice Center, Room 240 1851 2nd Avenue North Bessemer, Alabama 35020 Re: Erick L Fitzpatrick, Defendant, Jefferson County Criminal Court Case # 2015-0237, Bessemer Division, Charge of Aggravated Animal Cruelty Dear Judge Fancher: The captioned defendant is charged with aggravated animal cruelty. The attached affidavit of the arresting officer is attached hereto. The purpose of this letter is to draw to your attention the layout of the defendant’s house and the location of the dog pen where the animals were kept. When the defendant stands at any window that faces his backyard, he has an unobstructed view of the animals. I know this because I viewed his property via an aerial map. The dog pen is also in plain view of his driveway where he parks his cars. It is also in plain view of his neighbors and of anyone who drives by his house. There are no trees, bushes, or other obstructions to prevent the defendant from seeing the animals inside of the pen. When he is standing at any of his windows that face the back yard he has an even better view of the dog pen because it is elevated. When the arresting officers interviewed the defendant he stated that he “had not checked on the animals in a few days”. I urge you to impose the maximum sentence allowed by law upon this defendant because it took a long time for the dead dog to die of starvation. Therefore, the long slow agonizing death of the dead dog combined with the imminent deaths of the other dogs due to starvation is unusually cruel. The defendant, via his unobstructed view of the backyard from various positions inside and outside of his house, was keenly aware of their condition and did nothing to prevent it. I hope you will agree with me that when someone inflicts unusual cruelty upon innocent animals that they must sustain the harshest punishment. Sincerely, Judith Haney
