NEGOTIATING A REASONABLE EXIT PAYMENT The signs are not promising at work. You are fairly sure that you are on a list of staff who are being managed out of the workplace. If you give in and resign, you may receive several weeks’ salary and entitlements. In a weak employment market you need to work to maximize your payout. This may involve taking your employer to Fair Work, however this can be costly and with an uncertain outcome. It may be better to create a negotiation with your employer. This is done by confronting your manager with your belief (backed up by examples) that you are being unlawfully pushed out of the workplace. You should make it clear that you intend to keep doing your job to the best of your ability, and that you will not be resigning. You should also indicate that you would be open to discussing a voluntary departure which properly compensated you for termination of your employment and the time it would take you to find other suitable employment.
