The court said as a sitting head of government Modi is entitled to immunity. In dismissing the case filed by human rights group American Justice Centre (AJC) in New York, US District Judge Analisa Torres on Wednesday upheld the US Department of States determination regarding immunity for Modi. A sitting head of states immunity from jurisdiction is based on the Executive Branchs determination of official immunity without regard to the specific conduct alleged, she ruled. Torres dismissed the plaintiffs argument that the Foreign Sovereign Immunities Act provided immunity only to foreign states and not to individual government officials and Modi was not entitled to common law immunity as the alleged acts took place before he became Prime Minister. AJC filed the lawsuit against Modi under the Torture Victim Protection Act of 1991 and Alien Tort Statute in September on the eve of his first visit to the US. The dismissal of the case comes ahead of US President Barack Obamas second trip to India to be the chief guest at Indias Republic Day celebrations. The lawsuit alleged Modi did nothing to control riots in his home state of Gujarat in 2002. Though Indian courts have cleared Modi, the allegations led the US to revoke his US visa in 2005. But Obama overturned the ban by quickly inviting Modi to the US after Modis election as prime minister. NEW DELHI Union Minister Mukhtar Abbas Naqvi Taken Into Custody over Poll Code Violation Case, Gets Bail Union minister Mukhtar Abbas Naqvi was today briefly taken into custody in Uttar Pradesh and later granted bail in a case of poll code violation. A court in Rampur had sentenced him to one year in jail for violating the model code of conduct six years ago. It is a politically motivated case, Mr Naqvi said. The BJP leader was accused by the police of defying prohibitory orders while campaigning for the 2009 national election. Mr Naqvis convoy was stopped by the police for checking but his supporters reportedly protested outside a police station. Mr Naqvi reportedly addressed the protesting workers and was among 200 people booked at the time. 19 people, including the BJP leader, have been found guilty. The BJP has described the one-year jail sentence as overreaction to a peaceful protest. Mr Naqvi is the Minister of State for Minority Affairs in the central government. NASHIK Army jawans vandalise police station; 6 detained A group of army jawans allegedly vandalised a police station in Nashik on Wednesday and attacked several policemen, injuring three of them, while protesting the arrest of an army officer, police said. Six army jawans have been detained in this connection, Upnagar Police Station inspector Namrata Desai said. An army officer, from School of Artillery at Devlali Camp near here, had allegedly parked his vehicle near the Upnagar Police Station last night, which led to an altercation between him and police. Later, an FIR was registered at the police station against the officer who was subsequently arrested. But, the matter was resolved and the officer was released, Desai said. However, around 50-60 jawans in civilian clothes came to the police station on Wednesday at around 2 PM. They ransacked the furniture there and damaged some police vehicles parked outside the police station, she said. The police officer also alleged that the protesters locked her in her room and also beat up some policemen in which three constables sustained injuries and were later admitted to Nashik Civil hospital, Desai said. City Police Commissioner Kulwant Kumar Sarangal and other personnel rushed to the spot. A panchanama of the incident was being conducted, she said. Six army jawans from the School of Artillery at Devlali Camp were detained in connection with the incident, she added. GUJARAT Two dead, one critical after communal clashes in Bharuch Two persons died and one is in a critical condition in communal clashes that broke out in Bharuch district on Wednesday afternoon. The incident took place in Ambeta village in Hansot town of Bharuch on a day when Gujarat was celebrating the Makar Sankranti festival. According to the police, a fight between youths from two communities flared up into a communal situation as mobs of 250-500 people from two communities clashed in various locations of Hansot. They threw stones and damaged shops and religious places. The two deceased persons were killed with a sword. The police had to open firing to control the rioting mobs. “The fight itself was not on a religious issue. A youth from one community was passing through an area with residential concentration of another community. He was heckled by another youth and was beaten up. Following this incidents, communities rallied themselves,” the police told. For a month, communal tension was brewing in Hansot after a message decrying a particular religion was being circulated on WhatsApp. The police are in the process of registering an FIR. HYDERABAD Govt orders CBI inquiry into trainee IPS officer’s death The government has ordered a CBI probe into the death of a 31-year-old trainee IPS officer at the National Police Academy in Hyderabad last year. Sources said Home Minister Rajnath Singh ordered an investigation by the central agency after he received a report of an internal inquiry conducted in this regard. The trainee officer, Manu Mukt Manav, died after drowning in the swimming pool of the Sardar Vallabhbhai Patel National Police Academy (SVPNPA) on August 28.
