NEWS UPDATE AT 5PM BROUGHT TO YOU BY Orange Uganda Four Constitutional Court judges have unanimously ruled that the re-appointment of retired Chief Justice Benjamin Odoki was unconstitutional in a case in which the court was petitioned on whether President Yoweri Museveni was right to re-appoint him. In their ruling- as part of the five judges on the panel hearing the case today greed that the 1995 Constitution of the Republic of Uganda does not provide for such re-appointments. The case arose last year when President Museveni on July 9, 2013 wrote to the chairman of the Judicial Service Commission directing that Mr Odoki be given a two-year contract in order to “maximise the services of our human resource”. However, the reappointment was challenged in court by Western Youth MP Gerald Karuhanga on grounds that it was unconstitutional because he had clocked the mandatory constitutional retirement age of 70. ……………………………………….. Assessors have advised High Court Judge Duncan Gaswaga to acquit embattled businesswoman Jackie Uwera Nsenga of murder charges against her and instead convict her of a lighter charge of man slaughter for what they say was an accident. Giving their joint opinion today, Robert Lubega and Rehema Babirye told the judge they had no reason not to believe that the accused caused the death of her husband Juvenal Nsenga in January last year and cited the post-mortem report that indicated that he had died of multiple injuries caused by a blunt object on the deceased’s body. Juvenal Nsenga died after an accident in his home early last year. Gaswaga promised to deliver his judgment on notice after scrutinising the evidence presented by both prosecution and defence lawyers. According to the Gallup World Poll 2013, President Kenyatta received 78 per cent approval ratings behind Malis Ibrahim Keita who is leading with 86 percent. The lowest rating was the D.R.C President Joseph Kabila who received a job rating of 24 percent.
