NEWSDAY JANUARY 17, 2 K 14 Boy on bond charged with beating schoolboy By LAUREL V WILLIAMS Friday, January 17 2014 A 14-YEAR-OLD secondary school student, who was placed on a bond last month, appeared before a Chaguanas magistrate yesterday charged with beating a 13-year-old Form One student, near a KFC outlet. The Form Two schoolboy appeared before Magistrate Brambhanan Dubay, in the Third Court, charged with unlawfully assaulting Form One pupil Josiah Scott, 13, by beating. Both boys are students of the Chaguanas North Secondary School. The accused who cannot be named because he is legally a minor, was jointly charged with Akini Reid, 18, and Takille Maharaj, 20, with the offence. The trio was also jointly charged with resisting arrest by PC Villafana, of the Chaguanas Police Station. On both charges the minor pleaded guilty while co-accused men pleaded not guilty. Court prosecutor Sgt Ken Ali told the court that PC Villafana and other officers were on mobile patrol at about 3.20 pm on Wednesday when they responded to a disturbance report along the Southern Main Road, Montrose, Chaguanas. On arrival, Scott was injured and the minor and two other persons began to run off. The prosecutor added the police gave chase and arrested the trio a short distance away. Scott’s right eye was swollen yesterday when he attended the hearing. He was accompanied by his father, Garvin Scott. Prosecutor Ali labelled the Form Two student as the aggressor and recalled on December 16 last, the said teenager had appeared before another Chaguanas magistrate on an application for uncontrollable behaviour by his mother. That magistrate had placed the boy on a bond which was breeched due to his appearance yesterday before the court charged with the two offences. Attorney Taradath Singh represented the boy, who the court heard admitted to beating Scott. The attorney explained to the court his client had gone to KFC to purchase a meal, and while there, met the victim. Singh further said an argument ensued, and his client dealt Scott several blows. The victim told the court the accused started cuffing and kicking him when he fell to the ground, two other persons joined in and beat him. The boy’s father told Dubay only last month, the accused minor robbed his son of $3, leaving his son in fear. “I went to the school last month after the incident because I wanted to meet the guy (accused) to tell him to leave my son alone, and to give back the $3. But he was not in school... My son was vomiting blood after the incident,” said the father. The accused himself admitted to committing the act adding he, too, received several blows during the altercation on Wednesday. He however denied robbing Scott of $3. He added that his father died “a victim of crime” and accused a Mathematics teacher of constantly “provoking” him about it. The boy claimed the teacher often chased him out of the class. Dubay ordered a probation report of the accused minor, and remanded him at the St Michael Home for Boys. He will reappear in court on February 13. The two co-accused, both of whom were unrepresented by counsel, were also denied bail and remanded into police custody for tracing to be done. They will reappear in court on January 22.
