NOTICE TO : University community FROM : Prof LR van Staden Administrator DATE : 23 July 2013 SUBJECT : MANAGEMENT RESPONSE TO STRIKE ACTION: CONTEMPLATED LOCK OUT _______________________________________________________________________ The decision by Labour to strike means that it does not accept that the University does not presently have the financial resources to meet its demands. There is no rational basis for this belief because the facts are as stated by Management in the recent negotiations. All possible avenues from which additional funding might be obtained have been explored. In the light of these facts, the decision to strike taking account of the fact that WSU is unable to meet the financial demands placed on it, has led Management to consider applying a lock out in terms of the Labour Relations Act. This will be done if employees fail to acknowledge that their demands cannot be met at the present time. Unless the current position reverses itself, a decision on the lock out will be taken. A lock out entitles an employer to withhold pay to employees. This no pay rule applies to all staff, irrespective of whether or not certain individuals are willing to work. It means that the WSU workforce is required to consider whether its interests are best served by the current course of action. It must be understood that Management is, and at all times will remain, available and ready to enter into further talks concerning the question of its financial resources, should there be any doubt or need for further explanation. We accordingly look forward to hearing from Labour as a matter of urgency. In the absence of any response the lock out notice will be issued as presently contemplated. Thank you Professor Van Staden
