No power to amend by-laws: Sim Lim Square management to CASE The Consumers Association of Singapore had appealed to the management at Sim Lim Square and Peoples Park Complex to change their rules and by-laws, such that landlords can compel tenants to conduct business fairly. In a letter to CASE shared with the media on Friday (Dec 5), the MCST said it does not have the power to pass or amend by-laws for the purposes of managing business practices of retailers at Sim Lim Square. Neither can it compel subsidiary proprietors to manage business practices carried out by their tenants, unless the by-laws relate to the control and management of the use of enjoyment of the building. CASE had called on the management committees at Sim Lim Square and Peoples Park Complex to make it mandatory for all landlords to state that retailers must conduct their business in accordance to practices set out under the Consumer Protection (Fair Trading) Act (CPFTA). It had given the malls management a deadline of Friday to respond. Sim Lim Squares MCST added that while its council may persuade landlords to include clauses which require tenants to conduct their businesses fairly, it does not have the power to amend the by-laws to compel landlords to do so. The MCST added that unlike CASE or the Singapore Tourism Board, under the CPFTA, it is not one of the bodies empowered to apply for a court injunction to restrain an errant retailer from engaging in unfair practices. Our concern is that to make a by-law allowing the MCST to impose penalties against retailers who have engaged in unfair practices would be contrary to Parliament’s intention in enacting the CPFTA, it said. We note that there is no easy solution to the problem of errant retailers and we hope to work closely with your association to devise ways to alleviate the problem, the MCST said to CASE.
