...Now a report from CNS News (H/T WZ) sheds light on liberal tactics to bypass Congress and the Constitution to require the United States to obey international agreements written to control global warming. Obama administration officials plan to sign a “politically binding” U.N. agreement next year, and have a plan to make that agreement legally binding in the United States without congressional action, according to the report. Obama’s intention to sign the agreement represents a tacit admission by the president that he lacks the political capital to win approval of a new treaty by the Senate. “It’s quite clear under Article 2, Section 2 of the Constitution that after the president signs it, any binding international law agreement has to be ratified by the Senate,” said Christopher Horner, senior fellow at the Competitive Enterprise Institute. Therefore, Horner says, the plan is for “environmental activists” to file lawsuits arguing that America should be required to abide by international agreements “even if they are not ratified by the Senate.” It’s easy to see how this would play out — the right suit filed in the right court against a chosen government entity, and the supposedly adversarial groups, all of whom are actually on the side of climate change activism, settle out of court, essentially by agreeing to abide by the “treaty by another name.” The Founders created the Constitution for a reason, and that reason was to prevent tyranny by one person or by a group.
