OTHER HIGH COURT SENTENCES DELIVERED BY JUSTICE JOHN BOSCO ALLIEU IN PORT LOKO By Hassan Bruz Northern Bureau Chief In a bid to fulfil the promise made in my previous post to provide you with further details on the January High Court Session in Port Loko, I now wish to summarise at least 4 of the matters completed by the Presiding Judge –Honourable Justice John Bosco Allieu during this particular Session. These will include the matters of - Alhassan Conteh, Foday Sesay, Musa Kamara, Alusine Kamara and Saio Conteh whose charges ranged from unlawful possession of Small Fire Arms to Dangerous Driving and Manslaughter. Alhassan Conteh and Foday Sesay were both charged with the offence of Dangerous Driving. Alhassan Conteh had a total of 3 counts charge including Driving without due consideration to other road users, contrary to Section 101 of the Road Traffic Act Number 5 of 2007 and Failing to take the Vehicle in question for Examination Contrary to Section 59 sub section 3 of the Road Traffic Act number 5 of 2007. It was on Saturday 6th July 2013 when he was dangerously driving the Nissan Serena Van with registration number AHY 784 that led to the death of one Kebbie Forna. He pleaded guilty and was sentenced to a total of 10 years or pay the sum of 10 million Leones fine. As for Foday Sesay who was charged with the offence of Dangerous Driving and for Failing to report an Accident, as well as Driving without reasonable consideration to other road users, the Prosecution was not able to prove in Court that it was infact the Accused that was in actual control of the said vehicle at the time of the accident. This was confirmed by Santigie Mange- one of the witnesses at the scene of accident. He was therefore discharged on all Counts. Musa Kamara- a blacksmith by profession,was arraigned before the no nonsense Judge on a Manslaughter and unlawful possession of Small Arms and Ammunition. He was said to have unlawfully killed Alusine Turay – a 56 months old boy in the Dibia Chiefdom, Port Loko District. The incident occurred on Friday 23 rd August 2013 when an old locally made gun was brought to him for repairs. As testified by the witnesses, the Accused ensured that all the Kids around were kept off the area before he could commence the work. He was deeply busy cleaning the gun when a battered bullet exploded and accidently hit dead the 56 old boy who had unknowingly resurfaced at the scene. The Accused pleaded guilty and was sentenced to a 4 months jail for counts 1 and 2 while he was acquitted and discharged on 3. According to the Trial Judge, the Accused took all the necessary precautions even before he started cleaning the gun and was not aware the boy had returned to the scene noting that the act was not intentionally done. Saio Conteh was charged for the Unlawful Possession of Small Fire Arms and Ammunition without Licence contrary to Section 19 sub section 2 A of Act number 14 of 1965 as repealed and replaced by section 10 of Act number 7 of 1972. He was at Wandera Village in the Briamia Chiefdom in the Northern District of Kambia where he was found in possession of the Small Fire Arms without Licence. He pleaded as charged and was Sentenced to 6 months Imprisonment while his gun and ammunition were confiscated to the State. There was also the case of Alusine Kamara who was charged with the offences of Conspiracy contrary to Law, Store Breaking and Larceny Contrary to Section 26 sub section 1 of the Larceny Act of 1916. Himself and one Sorie Bangura broke and entered the Store of MODAL Company and stole therein 6 Foam Mattresses, 7 Lorry Springs, 3 Bundles of Zinc 8 Heavy Duty Lorry Batteries and other items to the total value of over 41 million Leones. These were Property of the Drivers For Attitudinal Change Company while in custody of David Bangura. He was found guilty and sentenced to 7 years in Jail on Count 2 but was Acquitted and Discharged on Count 1. The case of Amadu Conteh is the last I would like to end up with in this Post. He was brought in Court because he attempted to commit Suicide contrary to Law. He is said to have tied his throat with a piece of cloth and attempted to kill himself while on the 23th of July 2013 at the State Prison in Port Loko. Although he pleaded guilty as Charged, his demeanour made the Court to suspect that he was not of a sound mind and was therefore referred to a Mental Hospital where he should be observed for a period of 30 Days...
