PRESS RELEASE: ONTIVERO LAW on Housing Discrimination Civil Action against Marigold Gardens Condominium Association, Inc. Pembroke Pines, Broward County, Florida, September 16, 2014 ... Nerlin Ontivero, Esq., founder and managing partner of real estate litigation law firm ONTIVERO LAW, PA has advised and represented Winsome McDonald and all other named Defendants in an action filed against them by Marigold Gardens Condominium Association since October 2011. In October 2011, Marigold commenced eviction proceedings in Circuit Court under Broward County case CACE11-023389(09) in order to exclude Ms. McDonalds daughter and grandchildren from the premises based on living restrictions consistent with a senior housing facility. After conducting research into the record keeping of the Association, attorney Nerlin Ontivero, Esq., determined that it would be appropriate for Ms. McDonald to file a housing discrimination complaint in this matter. On April 18, 2012, Ms. McDonald, through the assistance of this law firm, filed a complaint with the Human Rights Section (Section) alleging housing discrimination in violation of Broward Countys Human Rights Act and federal law. The Human Rights Section, which, pursuant to a work-share agreement with the U.S. Department of Housing and Urban Development (HUD), investigates claims of housing discrimination, found reasonable cause to believe that Marigold discriminated against Ms. McDonald for reasons including that Marigold did not meet the documentation requirements to enforce restrictions consistent with a senior housing facility and, further, Marigold did not enforce its own age restrictions with regard to other residents. Settlement efforts were unsuccessful, so a formal charge of discrimination was prepared and filed with the County Human Rights Board. On August 21, 2014, Ms. McDonald, through this law firm, exercised her right to elect to have the dispute resolved through a civil court action instead of before the Human Rights Board. On September 9, 2014, Broward County Commission held a regular meeting where the issue of this case was brought up on agenda.
