REJOINDER: OFFICE OF THE PRESIDENT. I have read with surprise and sadness a feature that appeared on this page titled “statement from office of the president”. The opening sentence by the President alone is enough to halt this debate and discussion. He noted with much pleasure that, “As the president or our august union, I will defend and interpret the constitution at all times and will also be open for discussions which will strengthen the path we have chosen as a union”. BUT he comfortably MISLEADS us. Almost all the arguments raised by him are touted with fallacies and must be ignored and treated with deserved contempt. His statement is clear evidence to the fact that, the president had a wrong interpretation of the constitution of NUGS-RUSSIA. Hence, he continually acted in violation of it. I can now boldly accept this fact. He has deem it significant to defend the Constitution of the union but want to suppress people who also want to do same. I wish the President could have stated the Quorum of NEC at the very point he stated that “An incomplete NEC chaired by the vice president” According ARTICLE 23: QUORUM OF NEC: “Unless otherwise stated, NEC shall be duly constituted by The National President OR Vice President, Secretary and any other 2 members” Mr. President, you should have taking note of the key word “OR”. Then you would have appreciated that quorum is complete with/without you. Besides, you should have listed the members present at the meeting the Vice President organized to us. Then we can accept your invectives which are shrouded in a reckless abandon, without decorum and deference to the Vice President and the legitimate quorum of NEC that met and judiciously vested the constitutional mandate and power into the Members of Committee of Inquiry. By the way Mr. President on temporal leave, Are you vetoing on a legal matter involving yourself??? At a time your office is already dysfunctional and nonexistent, albeit temporary? Such act is ethically, logically and above all legally unacceptable. You have no locus Mr. President to make such statements. Furthermore, you should have told us where you derived your veto powers from??? Which article of the constitution gave you such power? Is it the constitution you intended to defend and interpret? NOW ON THE ROYAL SENATE: You absolutely erred on your arguments you raised. ARTICLE 36 (b) The Royal Senate (RS) shall Vet and approve nominations/appointments for UNION OFFICES, an ad hoc committee of enquiry is NOT a union office. Also, Mr. President, RS can enquire into issues referred to it or brought to its attention but that function is NOT EXCLUSIVE FOR THE RS ALONE. it has the capacity to do so but constitution permits NEC and Central Committee(CC) to also do it when it finds necessary pursuant to Article 19 (b) PORWERS AND DUTIES OF CC. Yes RS may debate issues and pass binding resolutions on them, RS is not only the body that can pass resolutions, but should they do so, it will bind other committee but as we speak RS has not passed any resolution to restrain the committee of enquiry. Moreover, This committee is valid under the constitution of our union under Article 19b and Article 24 (a), (b) Article 19 (b). CC shall appoint a sub or Ad-hoc committee, as it deems fit for the efficient running of NUGS-Russia. Article 24 The NEC shall a). see to the effective operation of the National Secretariat. b). see to the implementation of CCs policies and may initiate policies for the approval of CC. Recognizing Article 47(c): There shall be ad-hoc committees tasked for specific purposes as given by this constitution or per its terms of reference as stated by CC. Noting with full agreement to the letter of the Constitution of NUGS-Russia, The Committee of Enquiry is legitimate. The President’s actions are in violation of the constitutional mandate of aforementioned committee. This is an act of gross Misconduct and Malfeasance in office as well as abuse of office. And I pray thee Mr. President, who seeks to defend the constitution to eschew such acts and show respect for the constitution you want to defend. Finally, if Mr. President can come out at this time to tell us that the Vice President and 90% of the members of the committee of inquiry had not paid their dues, does that mean he has been condoling with them all this while? If yes, then I move for no confidence in HIM as the president and if no I want to ask why he appointed them to serve on various committees of the union with his full knowledge that they have not paid their dues? Hence I suggest to you Mr. President that these noble gentlemen have paid their dues and are in good standing that is why you have worked with them till date and have not terminated their appointments. Or you have deceived us and abetted wrong doing against the union and the constitution you claimed you want to defend. Infact The president’s actions are a typical example of a drowning man gasping for last breath to hold on to life. CONCLUTION: I entreat and advice the President not to INTERFERE with Justice. He should humbly allow Justice to be administered. He should continue to defend the constitution and allow the legitimate mandated committee of inquiry to operate and do their work.
