Regarding Obamas immigration executive order: Theres been a lot of discussion about Obamas actions Monday, but constitutionally this is very simple. There is NO constitutional executive order power - the President is simply required to enforce the laws. Regarding immigration, the laws are already in place. The President is required to enforce those laws. Immigrants are welcome to come to the U S, but they must follow procedure. If they are here in violation of those rules, they are violating the law, and the President is REQUIRED to deport them. He just signed an executive order stating that he is refusing to enforce current immigration laws. This is a violation of the Constitution - specifically the Presidential Oath of Office: to preserve, protect and defend the Constitution of the United States. Article 2, Section 1, Clause 8. And he shall take Care that the Laws be faithfully executed Article 2, Section 3 And This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land;Article 6, Clause 2 And regarding immigration legislation itself: To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States; Article 1, Section 8, Clause 4 Additionally, Ive seen arguments in support of Obamas actions, quoting the Presidential power to grant pardons. Obama did not grant illegal immigrants a pardon, he stated he will not enforce current law.
