Regular Meeting - August 22, 1967 The Board of County Commissioners of Santa Rosa County, Florida met in regular session on the above date with all members present. The meeting was called to order by Chairman Fowler at 9:00 A.M. and opened with prayer by Rev. Ray. The first item of business was street area in Hickory Shores # 2. Fowler brought it up for discussion and advised the matter is still not settled. He said he has talked with several residents of the area and with Rev. McWaters, and felt it would be more desirable to leave the road open, but not clear or do any improving to it. Wilson said he has been advised that the facts were misrepresented at the hearing on the closing and, upon request of the property owners, moved another hearing be set for 10:00 A.M. Tuesday, September 26, 1967. Kelley seconded the motion and it carried by unanimous vote. The Board instructed the Clerk to write a letter to Mr. McWaters advising that no further clearing or improvements were to be made on this right of way until further notice from the Board. Wilson moved that due to problems encountered which need further study, the action taken by this board on July 25, 1967 and recorded on page 428 of this book, which concerns garbage control, be rescinded and the garbage pit be moved back across the river. Kelley seconded the motion and it carried by unanimous vote. (The Board had notified the cities and private haulers that effective Oct. 1, 1967 they must assist financially with garbage control or make arrangements to cover their own.) Mr. Reed advised that Mr. Glover has requested a thirty day leave of absence. Mr. Glover has used his vacation and sick leave time and understands this will be without pay. Wilson moved the request be granted, which was seconded by Wise and carried by unanimous vote. Attorney George Lowrey, representing the First National Bank, requested the exchange of some right of way. He said right of way was donated for a road on the Rolling Greens Country Club Property; but the road was not constructed on the right of way. They would like to donated the property where the road is constructed for a quit claim deed to the property where the road should have been. He also requested a quit claim deed to a short cross street in the same area, which he said is a road right of way; but has never been used. The Clerk advised that he has not been able to find any record of where the county has any interest or owns the property in question. However, Mr. Lowery said this action is necessary in order for them to proceed with a loan from FHA for improvements. Upon advise of our attorney Wise moved the exchange be approved, which was seconded by Barnes and carried by unanimous vote. DESCRIPTION: From First National Bank in Milton Commence at the Southwest corner of Section 29, Township 2 North, Range 28 West, Santa Rosa County, Florida; thence go due north along the West line of said section a distance of 1812.07 feet to its intersection with the centerline of the Southern Bell Telephone Company easement; thence go North 77 degrees 54 East along the centerline of said easement a distance of 25.57 feet to the East right of way of a county road and the point of beginning, thence go due South a distance of 15.34 feet; thence go North 77 degrees 54 East a distance of 1958.35 feet; thence go North 0 degrees 20 East a distance of 33.79 feet; thence go South 77 degrees 54 West a distance of 1958.55 feet, thence go due South a distance of 18.41 feet to the point of beginning. OR Book 162 at Page 59 and 60) DESCRIPTION: From Santa Rosa County, Florida Begin at the Southeast corner of the West half of Section 29, Township 2 North, Range 28 West, thence run North 88 degrees 48 West 435.07 feet for the point of beginning, thence run North 0 degrees 15 East 555.67 feet, thence angle to the left 90 degrees for a distance of 60.01 feet, thence run South 0 degrees 15 West 555.67 feet more or less to the South line of said Section 29, thence South 88 degrees 48 East along the south line of said Section 60.01 feet more or less to the point of beginning. Begin at the Southwest corner of Section 29, Township 2 North, Range 29 West, thence run due North 1798.73 feet to a point; thence run North 77 degrees 45 East 2685.89 feet to a point, thence run South 0 degrees 15 West 35.84 feet to a point, thence South 77 degrees 45 West 2685.89 feet to the West line of said section; thence due North along the West line of said section 35.84 feet to the point of beginning. OR Book 162 at Page 58) Today was the day set for the hearing on the closing of a 10 foot alleyway as shown as Plat in Deed Book A-8 at page 452 through 453, being a plat of Milton Parkway Subdivision. No one appearing to protest the closing and the Board determining it was in the best interest of the public, Barnes moved the alleyway be closed and the following resolution be adopted, which was seconded by Wilson and carried by unanimous vote. RESOLUTION: WHEREAS, Jess Holmes and Wilene Holmes, husband and wife, through their duly constituted attorney at Law, appeared before the Board of County Commissioners of Santa Rosa County, Florida, with a petition to vacate, discontinue and close that certain 10 foot alleyway as shown on Plat in Deed Book A-8 at page 452 through 453, of the public records of Santa Rosa County, Florida, being a plat of Milton Parkway Subdivision, said alleyway being located between Lot 3 and Lot 4 of Block 7 of said subdivision, and WHEREAS, the Board of County Commissioners has determined that the petitioners are owners of various parcels of land in said Subdivision, and that the owners of the above described parcel join with the petitioner; that the publication of their intention to present said petition to the Board on this date was given in accordance with Chapter 192.30, Section 1, of the General Statutes of Florida, and that there are no delinquent taxes outstanding against said property; and WHEREAS, the Board of County Commissioners has determined that the public interest will be best protected and served by vacating and abandoning said subdivision; and WHEREAS, the Board of County Commissioners is fully advised and informed of the premises involved herein; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Santa Rosa County, Florida, that the aforesaid portion of said subdivision as are heretofore herein set out and described, be hereby vacated and abandoned, and that any and all interest in the public pursuant to the said plat shall revert to and be vested in the proper owners thereof. Kelley /s/ Clifford Wilson /s/ Ray C. Helms, Clerk Mr. Maxwell Ates again appeared before the Board concerning the return of taxes, which he said was an overpayment of the 1966 tax year. Attorney Johnson advised the Board that Tax Assesor, F. M. Fisher, has advised him there was an error in Mr. Ates taxes in that he was assessed with 100 feet which belonged to another property owner and 280 feet Mr. Ates owns which was classified as commercial and should have been residential. Mr. Fisher would recommend a refund of taxes paid on $8,800, which came about through error in assessment. Mr. Johnson advised the Board they have the authority to refund this amount if and when it is approved by the State Comptroller. Chapter 193.40 Florida Statutes of 1965 requires the approval of the Comptroller. The Board instructed the Clerk to forward to the Comptroller a request for approval of taxes paid on the $8,800. The Clerk read a letter to the Board from G. L. Dickenson, District Engineer, State Road Department, which assured that secondary funds would be used only for the acquisition of right of way and that they would not be used for construction of the Industrial Road unless further authorization was made by the Board of County Commissioners. (The Board has previously refused to execute the contracts for Section 58522-2601 as they requested it be constructed from Primary Funds). After some discussion Wise moved the instruments be executed for acquisition of right of way only for Section 58522-2601 - State Road S-281A - extending from Del Monte Road Northerly and Westerly to State Road S-191-A including Leg. Barnes seconded the motion and it carried by unanimous vote. The Board was advised by letter that the Bond for James Stanley Lane, Deputy Sheriff, has been cancelled. Mr. Lane is no longer employed by the Sheriffs Department. In answer to our letter to St. Regis paper Company requesting that they donate property at various locations for the construction of boat launching ramps, Mr. Maynard Stitt, Public Relations Manager, advised that St. Regis itself is construction these ramps at the locations mentioned in our letter. He said they prefer to do this themselves instead of conveying the land to the state. Wise moved a letter be written St. Regis expressing our appreciation for their interest and cooperation. Barnes seconded the motion and it carried by unanimous vote. Sam Marshall of Marshall & MacNeil, Architects, presented for approval of the Board an agreement for additions to the Santa Rosa County Health Center which provided for 7%. The Board already has a signed contract with Mr. Marshall for 6%. Wise moved we proceed with the original contract at 6%, which was seconded by Barnes and carried by unanimous vote. The Bids which were previously tabled for the tractor, disk and bush hog were again discussed by the Board. After some consideration Wise moved the bid submitted by Burns Tractor Company, which was the only bid received, be accepted as follows: (1) One #165 Massey Ferguson Diesel Tractor $4,191.88 (1) One 7 Tygart Lift Type Disc 366.00 (1) One # 60 Massey-Ferguson Rotary Cutter 400.00 Kelley seconded the motion and it carried by unanimous vote. Wilson moved the approval of the following right of way deeds, which was seconded by Kelley and carried by unanimous vote. FROM: John Henry Lundy and Marion Allen Lundy DESCRIPTION: Commencing at the Southwest corner of Lot 4, Section 6, T1N, N27W, thence North along the West line of said Section 1237.56 feet to point of beginning, thence continue North 50 feet, thence East 1209.28 feet, thence South 0 degrees 18 08 West 50 feet, thence West 1209.01 feet to point of beginning. (Recorded in OR Book 162 at Page 51 and 52 At the request of Mr. Marques, Jr., President of the Pensacola Area Chamber of Commerce, and in the interest of better roads for the County and state, Wilson offered the following Resolution, which was seconded by Kelley and carried by unanimous vote. RESOLUTION: WHEREAS, good roads and highways are important to the sound development of Northwest Florida, and WHEREAS, at this time there exists no four-land highway, interstate or otherwise, running throughout Northwest Florida, and WHEREAS, final plans for the location of Interstate 10 through Northwest Florida have been made, and WHEREAS, the completion date for Interstate 10 has on several occasions been delayed, and WHEREAS, the completion of Interstate 10 throughout Northwest Florida would provide the first and only four-lane highway throughout Northwest Florida and would serve as a four-lane connector to other interstate highways already existing in the state, and WHEREAS, the early completion of Interstate 10 would vitally affect all the citizens of Northwest Florida, and WHEREAS, the speedy and early completion of Interstate 10 if of utmost importance to the development of Northwest Florida, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF SANTA ROSA COUNTY, AS FOLLOWS: That this Board represents that a transportation emergency exists in Northwest Florida and urges the State Road Department, the United States Bureau of Roads, the Legislature of the State of Florida and the Congressman representing the First and Second Districts of the State of Florida to make all necessary arrangements for the earliest possible completion of Interstate 10 throughout Northwest Florida in order to alleviate conditions now existing and provide adequate and safe road transportation facilities throughout Northwest Florida. BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Chairman of the State Road Department; the Director of the United States Bureau of Roads; the Honorable Robert L. F. Sikes, Member of Congress; the Honorable Don Fuqua, Member of Congress; members of the Legislature of the State of Florida representing Northwest Florida; and all other parties directly concerned. Of this amount .22 of a mill goes for outstanding indebtedness in the Fine and Forfeiture Fund. Upon motion by Kelley and seconded by Barnes the following donations were made from the welfare fund. The motion carried by unanimous vote. (1) Charles Parkton $ 10.00 (2) Julia Faye Lucas $ 15.00 Mr. William Zorn, County Agent, advised the Board that Irene Hawley, Assistant Home Ec. Agent, has submitted her resignation to be effective Sept. 30, 1967. She and her husband are moving to Illinois where she will take a position as Home Ec. Agent. Mrs. Lee Ann Casey will replace Mrs. Hawley effective October 1, 1967. Wise moved we accept the resignation of Mrs. Hawley and approve the appointment of Mrs. Casey to replace her. Barnes seconded the motion and it carried by unanimous vote. Wise moved a resolution be drawn commending Mrs. Hawley for the fine job she did while serving in the position as Assistant Home Ec. Agent and a copy be furnished her, and one be sent to her Supervisor in Illinois. Barnes seconded the motion and it carried by unanimous vote. Lonnie Skinner appeared before the Board representing the East Milton Volunteer Fire Department, along with thirteen other interested persons. They were interested in securing the acre of land owned by the county and located just off Highway 90 East in Section 2, T1N, R28W, for the Fire Department. It was brought to the attention of Mr. Skinner that this parcel of property is landlocked; but he said they felt something could be worked out. After some discussion, Wilson moved we call for bids to consider the sale of this property, and set the opening for 10:00 A.M. on Tuesday, September 26, 1967, Kelley seconded the motion and it carried by unanimous vote. Ed Gentry of Watkins, Morrow and Company, came before the Board concerning the next step for the Non-Profit Corporation in connection with the construction of the hospital. He read the Articles of Incorporation Of Santa Rosa County Hospital Authority, Inc. The subscribers to these articles, and members who would constitute the first Board of Trustees, were: (1) Clifford Wilson (2) William S. Rosasco, III (3) Albert Golden (4) E. L. Fortune (5) E. W. Sutton (5) John P. Merchant. Officers were: Chairman: Clifford Wilson, Secretary: E. L. Fortune, and Treasurer: Albert Golden. After some discussion and consideration, Kelley moved the approval, which was seconded by Wise and carried by unanimous vote. (This motion was for the approval of the subscribers and officers only. The Articles of Incorporation does not require approval of the Board). The Clerk advised that the State Road Department is ready to let the contract for the resurfacing of Highway # 191A (Bagdad Highway); but will need a resolution setting out the project from which the required funds will be deducted. Kelley moved the funds be made available for this project by deducting the required amount from the last project on the secondary list for which funds have been set aside. Wilson seconded the motion and it carried by unanimous vote. Due to an error in the description, the hearing on the closing of a street in Avalon Beach could not be taken up. Mr. Staros requested another date be set to determine the feasibility of closing the street area. Wilson moved this be set for September 26, 1967, which was seconded by Barnes and carried by unanimous vote. Mr. Reed advised that he received three bids for the outboard motors. The highest one was $98.00, submitted from Oscar H. Hatcher, which was accepted. (This sale was authorized by the Board and is recorded on page 422) There being no further business to come before the Board at this time the meeting adjourned.
