Rick Perry’s lawyers file 60-page motion to dismiss case Attorneys for Gov. Rick Perry on Monday morning filed a 60-page motion to dismiss charges against the governor stemming from his veto last year of state money for the Travis County district attorney’s office after Rosemary Lehmberg refused to resign. Perry’s defense team had said last week that they planned to submit an application for a pretrial writ of habeas corpus striking at the heart of the case against the governor. The motion contends Perry had the constitutional right to veto the money and the charges attempt to violate his right to free speech. Perry’s application also suggests that his lawyers will file a separate motion to dismiss the two-count indictment for failure to adequately state a violation of the two laws. “Those arguments will not be addressed now, because pretrial habeas corpus is not the remedy for factual inadequacy, even when that inadequacy is as blatant as it is here,” the writ application states. A Travis County grand jury indicted Perry 10 days ago on felony charges of coercion of a public servant and abuse of official capacity.
