SUPPORT TO PROTECT THE CONSTITUTION On 5 February 2013 the Parliament amended Section 145(4) of the Constitution effectively prohibiting itself from keeping any corrupt government accountable through a motion of no confidence. No Parliament in a democratic system of government passes laws removing its own power (i.e. the People’s power) to keep the executive arm accountable because it is contrary to the doctrine of separation of powers. It is against the People’s wishes! On 3 December 2013, Chief Ila Geno, for and on behalf of all citizens, filed a Supreme Court Application SCA No 177 of 2013 challenging the constitutionality of the Parliament’s amendment of Section 145(4). Prominent Constitutional Law Lawyer, Nemo Yalo, who is mostly meeting the legal costs himself is representing Mr Geno. On 28 February 2014 the Supreme Court declared that Chief Ila Geno has Standing to represent the citizens and bring the proceedings. The substantive issues will be argued in April 2014 and a final decision will follow soon after. Mr Geno no longer holds public office but he is passionate and cares about the nation, its Constitution and the future generation. All concerned persons must support Mr Geno and Mr Yalo with the legal costs for the Court challenge. There is no point expressing our genuine concerns through the social media or media generally if they yield no desired tangible results. Well-qualified and experienced national companies are made to stand and watch or overlooked whilst foreign companies who only arrived yesterday are offered multi-million Kina public contracts at highly inflated prices and no form of accountability is the new norm. The Constitutional oversight agencies seem to have no interest to investigate and prosecute corrupt leaders at the top level is also the new norm. It is time for all citizens to rise up and protect our Constitution and our country and our future!
