Section 29(1) of the Constitution provides that everyone has the right - a) To a basic education b) To further education It does not explicitly exclude higher education from being a right, the notion that higher education is a privilege is derived from common law which in my view is utter nonsense especially given the history of this country, in my opinion everyone in a civilised progressive country must have access to free higher education. By making higher education available only to those who can afford it, our government is ensuring that people who are born into well off families will remain that way and those born into poor families will remain that way. This will serve to exacerbate the growing gap between rich and poor, nowadays you can not get a decent job without a degree, diploma or certificate. Making higher education a right is not about giving people a free ride, theyd still have to work to get their degree, its about levelling the playing field, how else are we suppose to rectify the injustices of the past? Denmark and France are some of the countries that have offered free higher education, we can do it to.
