Since the city is required by the FAA to keep the airport open in perpetuity, why does Measure LC, which PROHIBITS DEVELOPMENT on airport property, also affirm the citys right to manage (or even close) the airport? Good question. The answer is simple... 1) The City Council finally did something right and followed a voter mandate to shorten the runway to limit jets and voted to BUILD A PARK in its place. 2) The corporate jet lobbyists freaked out and got Measure D on the ballot by misrepresenting that vote (severely restricting the citys ability to regulate the airport) by claiming the council was going to develop the crap out of the area. Provably not true. 3) To counter this, the Council wrote Measure LC, EXPLICITLY LIMITING DEVELOPMENT, tying their own hands and all future council hands. It was an unprecedented release of power. THEREFORE: In order for LC to take precedence if both LC & D pass, LC has to be in direct conflict with D. D says the council doesnt have the authority to close the airport. Therefore LC has to affirm that authority. It was a legal requirement. BUT THE AIRPORT CANNOT CLOSE. This is all about a small portion of the airport - the only portion the city has authority over. Google 1948 Instrument of Transfer (the agreement that says the airport must stay open forever) and Santa Monica Airport or read it here in an aviation industrys own publication here: While a 1948 Instrument of Transfer agreement with the federal government stipulates that SMO be operated as an airport in perpetuity, the city believes that a 35-acre parcel on the west side of the airport is not subject to that agreement.
