Speaking as a lawyer now, it is irrelevant to me what the Brown and Garner and other recent grand juries have concluded. Those No True Bill determinations are an obvious sham. We evidently have a growing issue in this nation with grand juries being guided and directed by corrupt prosecutors withholding evidence and leading them in a particular direction down the garden path. Justice, such as it is, only serves the state. This is bass-ackwards. This is why I have recently proposed the idea of Citizen Oversight Commissions for the criminal justice process to be instituted in every jurisdiction because we have a SERIOUS problem with a persistent miscarriage of justice as it pertains to police misconduct. I suggest further that the presentation of evidence should no longer be in the hands of the D.A.s. It appears to me that a Special Counsel selected by the citizens should conduct these grand jury inquiries, free of prosecutorial driving and interference. I am not at all convinced anymore that prosecutors can be entirely trusted to present all the exculpatory evidence, and Im not even sure they are correctly presenting and explaining the law. What they are obviously NOT doing is explaining 4th Amendment rights to the jury, that much is certain. Nor are the judges stepping in to advise and redirect the inquiry, either, so the judges are there to uphold the state tribunal and are not protecting citizens constitutional rights. An ill-informed grand jury--ill-informed because facts and evidence and law are being withheld from them--cannot be relied on to reach proper conclusions under the Constitution.
