Special Judge under the Prevention of Corruption Act B.P.Deshpande today directed Goa’s former Director of Prosecution Shobha Dhumaskar to remain present in Court on November 7th at 2.30 pm. Shobha Dhumaskar who is facing corruption charges under Section 13 (2) read with Sections 13 (1) (d) (i) & (ii) of the Prevention of Corruption Act, 1988 had failed to remain present in Court despite having been summoned as an accused two months ago. Today her lawyer submitted a medical certificate issued by Mapusa based orthopedic surgeon Dr Harish Tople that Shobha Dhumaskar has been advised three weeks complete bed rest but when Judge Deshpande stated that the doctor would be summoned to ascertain the veracity of the medical certificate the lawyer for Shobha Dhumaskar quickly agreed to keep her present in Court on November 7th. Earlier the Court’s attention was drawn that Shobha Dhumaskar had been evading to attend Court on fabricated medical certificates while she was seen all over except in Court. The accused Shobha Dhumaskar more so having been the Director of Prosecution should have respectfully submitted to the Court’s jurisdiction instead of making a mockery of the Justice delivery system. On 6th September the CBI Court while rejecting the plea by the Anti– Corruption branch (ACB) to close the corruption case against Shobha Dhumaskar directed her to face trial as there was sufficient material to prima facie establish commission of an offences by the former Director of Prosecution punishable under section 13(2) read with Sections 13(1) (d) (i) and (ii) of the Prevention of Corruption Act, 1988. Meanwhile the Special Judge under the Prevention of Corruption B.P Deshpande today adjourned to November 7th hearing of the final arguments on the petition filed against Rajendra Arlekar Speaker of the Goa Legislative Assembly in the disproportionate assets case. After hearing final arguments in the case against Rajendra Arlekar the Judge PV Sawaikar of the CBI Court had fixed the case for judgment on October 17th but just a day earlier on 16th October he was divested of his powers to hear matters under the Prevention of Corruption Act.
