Srinagar: Supreme Court of India has granted bail to five accused in the 2012 Common Entrance Test cash-for-paper scam involving former BOPEE chairman Mushtaq Ahmad Peer. Disposing of a number of Special Leave Petitions, a division bench of the apex court comprising justices Dipak Misra and V Gopala Gowda granted bail to Ahmad Faraz, Yasir Yousuf Hajam, Mohammad Iqbal Reshi, Yasir Yousuf Dar, Farooq Ahmed Shah and Mushtaq Ahmad Lone. In their petitions, they said that on the application for grant of bail being declined by the Trial Judge as well as by the High Court, they remained in custody for almost several months. The fact, court observed, is not disputed by advocate Ashok Mathur, counsel appearing for the State. “Regard being had to the facts and circumstances of the case, we are inclined to enlarge the petitioner on bail to the satisfaction of the Trial Judge. It will be open to the learned Trial Judge to impose apposite conditions, as advised in the obtaining factual matrix,” the court said while disposing of Faraz’s petition. Similar orders were passed in cases of all other accused.
