Standard Drainage Clause in Schedule of Easements There are standard words relating to drainage easements provided in the Schedule of Easements created when blocks are subdivided. The standard words are designed to automatically set up the necessary network of drainage rights to the extent the drainage easements are illustrated on the subdivision plan. The surveyor plots the drainage easements on the survey plan and the Schedule of Easements specifies the benefit and burden of rights of drainage with either the standard words or dedicated clauses. Drainage and pipeline easements are property rights to use the land related to water. The right to the water itself is regulated by the state government and licences may be needed to draw and use water from a creek, river or dam. What is a Service Easement? A service easement is typically a more general right to run pipes and wire with perhaps a right to way on the same land. There is not a standard wording for a service easement. Check if the right to run pipes and wire is or should be limited to be below ground. What is a Wayleave Easement? A wayleave easement is typically a right to run electrical wires with perhaps prohibition against building under or near the wires. Electricity companies tend to use a standard set of words for a wayleave easement but you need to check the wording each time.
