Supreme court dismisses rapist appeal A 40-year-old man serving a 16-year-jail term over the rape of a 10-year-old girl in Muanikoso between 2008 and 2009 has had his appeal dismissed by the Supreme Court. Anand Abhay Raj, 40, had applied for a special leave against conviction. He was convicted in 2010 on four counts of rape and one count of indecent assault by a high court in Suva. He was sentenced for 16 years in jail with a non parole period of 12 years. Raj filed a petition of appeal in July where he raised two grounds, one was concerning a failure to direct on recent complaint evidence and the other against excessive sentence. The Supreme Court judges endorsed the statements of the Court of Appeal judge that it was also a high end for such sentence. “This child suffered greatly and the punishment must reflect society’s abhorrence of such prolonged ill-treatment and abuse,” the judgment read. The judgment was delivered by a coram comprising Chief Justice Anthony Gates, Justice Sathyaa Hettige and Justice Chandra Ekanayake.
