Suspicion cant substitute proof, court says A trial court acquitted five men of charges of conspiring and murdering a man in 2011. The court said suspicion, however strong, can never take the place of proof. Additional sessions judge Umed Singh Grewal freed Durbeen Singh, Pushpal Singh, Trimal, Hashim and Gulfam of the charges of murder and criminal conspiracy under the IndianPenal Code, saying the prosecution failed to prove its case. The men were accused of killing one Vivek Chaubey in January 2011 after Chaubey molested the wife of one of the accused. The court also observed that it was one of the fundamental principles of criminal jurisprudence that the accused is presumed to be innocent till proven guilty . “Presumption of innocence has been recognized as a human right which cannot be wished away ,“ it said.
