THE MARRIAGE FRAUD INVESTIGATION - A young couple came to my office recently with a familiar story. The husband, a United States citizen, sponsored his wife for the Green Card. Because she legally entered the U.S., with a visa, she was eligible to adjust her status in the United States. The couple listened to their friends and to save money, they prepared and file their own applications. Eventually, an immigration interview date was scheduled by USCIS, which they attended without an attorney. At the interview, they were interviewed separately, which is a Stokes interview and were questioned about their courtship and life. They were informed that it was a crime to enter into a marriage for immigration benefits and that they will be prosecuted criminally if they lie. They were nervous and forgot simple facts about the marriage. The immigration officer concluded that this was a marriage of convenience. The applicants were escorted out. As a parting word the interviewer said, You will be notified through the mail. A few months after coming to my office, they were arrested and charged with marriage fraud and visa fraud. Thankfully, we were able to get the criminal charges dropped. My office has helped hundreds of couples in this dilemna.
