THINGS YOU NEED TO KNOW... FEDERAL LEGISLATIVE APPROPRIATIONS SCORE CARD FOR NKWERRE/NWANGELE/ISU/NJABA FEDERAL CONSTITUENCY 2011 – 2013. PACKAGED BY: MR. MIKE IKOKWU, PDP ASPIRANT FOR NKWERRE/NWANGELE/ISU/NJABA FEDERAL CONSTITUENCY. SOURCE: FEDERAL GOVERNMENT OF NIGERIA APPROPRIATIONS ACT FOR 2011, 2012 AND 2013. BACKGROUND: Fiscal appropriations for Federal Government funded capital projects and empowerment programs are linked to a Federal Legislator’s appropriation and oversight responsibilities. This is because in carrying out appropriation functions which lead to the approval of annual federal budget, Federal Legislators representing their various federal constituencies and Senatorial Districts get involved in ensuring that the interest and needs of their constituents are captured. Furthermore, Federal Legislators and Senators through their legislative aids and apparatus of government carry our oversight to ensure that the appropriations they have made are judiciously executed in line with section 88 (1 A and B) of the 1999 constitution of the Federal Republic of Nigeria which gives power to the each house of the National Assembly to direct or cause to be directed an investigation into; a. any matter or thing with respect to which it has power to make laws; and b. the conduct of affairs of any person, authority, ministry or government department charged or intended to be charged, with the duty of or responsibility for: i. executing or administrating laws enacted by the National Assembly ii. disbursing or administering moneys appropriated or to be appropriated by the National Assembly. Section 88 (2.) The Powers Conferred on the National Assembly under the Provisions of this section are exercisable only for the purpose of enabling it to: a. Make laws with respect to any matter within its legislative competence and correct any defects in existing laws: and b. expose corruption, in efficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it. These provisions of the 1999 constitution of the Federal Republic of Nigeria as it concerns Federal Legislative functions make it imperative that a legislator representing Nkwerre/Nwangele/Isu/Njaba Federal Constituency at the National Assembly has a responsibility of ensuring that allocation of funds for projects or allocation of projects for which funds are appropriated through the federal budget and subsequently released through the MDA’s do not elude Nkwerre/Nwangele/Isu/Njaba Federal Constituency. It is based on this knowledge of legislative function of a federal legislator and the right of the constituents or voters of the federal constituency to benefit from governance that the decision to analyze fiscal allocations that have accrued to Nkwerre/Nwangele/Isu/Njaba Federal Constituency from 2011 to 2013 fiscal years become very necessary. JUSTIFICATION Preparations for the 2015 general elections have thrown up several persons wishing to be elected to represent Nkwerre/Nwangele/Isu/Njaba Federal Constituency at the Federal House of Representatives. Both the political party Members who shall be voting for them at the primary elections and the electorates who shall be voting for those that emerge as Candidates at the main elections are expected to be briefed by those intending to represent them on their level of knowledge on legislative functions. Therefore, articulated presentation of the fiscal appropriations made for Nkwerre/Nwangele/Isu/Njaba Federal Constituency from 2011 to 2013 reveals not only the Commitment of the aspirant, but also, proves that the aspirant is aware of the challenges of his people in terms of quality representation. Again, the political culture of deceit, falsehood and manipulation have thrown up aspirants who may not be willing to assess the performance of their predecessor to know if he did well, so as to improve or did badly, so as to start to lay foundation for better performance. For those not willing to assess their predecessor, it could be because they share in his style of representation. Hence, there will be no need to expose his inadequacies, so as not to attract same to themselves when they emerge. Those who wish to offer their constituents better and quality representation that will be a departure from what it was in the past, will certainly analyse the situation and take a position. Offering the electorates opportunity for political education through exposition on how they have been represented is a politically expedient step to take where an aspirant or candidate have respect for those he is seeking their support. Consequently, analysis of legislative performance in a federal constituency by one who intends to be elected, is a preparatory step as well as political education exercise that will enable constituents who shall be exposed to the result of the analysis make a better decision and choice before voting. It is based on these justifiable reasons that analysis of fiscal allocations to Nkwerre/Nwangele/Isu/Njaba Federal Constituency 2011 – 2013 is being carried out in comparative terms with Orlu/Orsu/Oru East Federal Constituency. PROJECT SCOPE: This analysis is focused on Comparative Presentation of Federal Capital appropriations made for Nkwerre/Nwangele/Isu/Njaba Federal Constituency and Orlu/Orsu/Oru East Federal Constituency for 2011, 2012 and 2013 fiscal years. The source of information and data is Primarily the Federal Appropriations Act for 2011, 2012 and 2013. POPULATION: Political information on Imo State according to 2006 census figure reveals that Nkwerre has 80,152 persons with 108 polling units, Njaba 145,110 persons and 115 pulling units, Isu has 164,468 persons with 118 pulling units, Nwangele has 128,472 persons and 99 polling units. This means that Nkwerre, Nwangele, Isu/Njaba Federal Constituency has a total Population of 518,202 and total number of 440 polling Units. Orlu/Orsu/Oru East Federal Constituency has fallows: Orlu 142,717 and 163 polling Units, Orsu-120,003 and 116 polling Units, Oru East – 111,822 and 114 polling Units. This means that the population of Orlu/Orsu/Oru East Federal Constituency is 374,542 while the total number of polling units is 393. CRITICAL ISSUES ON CAPITAL APPROPRIATIONS FOR NKWERRE/NWANGELE/ISU/NJABA FEDERAL CONSTITUENCY FOR 2011, 2012 AND 2013. 1. The fact that stakeholders in the politics and development of Nkwerre/Nwangele/Isu/Njaba Federal Constituency were not consulted to identify their needs and make input before any of the appropriations stated here was made calls to question, the level of understanding of legislative functions among our stakeholders who wish that our Federal Constituency should develop. It also calls to question, the level of communication that exist between our constituents and National Assembly. This is important because, Legislative representation bestows the responsibility of upholding social justice and protecting the democratic rights of constituents of a legislative constituency on their Legislator. This becomes very important when viewed from the point of constitutional provision in Section 14(2)(a) of the 1999 constitution of the Federal Republic of Nigeria which states that “sovereignty belongs to the people of Nigeria from whom government through this constitution derives all its powers and authority”. If sovereignty which entails the power to elect a representative for Nkwerre/Nwangele/Isu/Njaba Federal constituency rest of the electorates of the constituency, it means that whoever they elect is their servant sent to represent them. It therefore means that in carrying out his appropriation functions at the Federal House of Representatives on their behalf, he should consult the constituents who elected him. He should also inform them of projects put in the budget for their good without their asking for it. He should also inform them about the Projects executed and the ones not executed at the end of every quarter or fiscal year. Failure to do this amounts to abuse of the sovereign right of the people of Nkwerre/Nwangele/Isu/Njaba Federal constituency. The scored card presented here also concern the provisions in Section 14(2)(b) of the 1999 Constitution of the Federal Republic of Nigeria which States that “the Security and Welfare of the people shall be the Primary purpose of government” funding and execution of the projects listed in this score card which are extract from Federal Government’s Appropriations Act for 2011, 2012 and 2013 are expected to improve the welfare and security of our people. Unfortunately, there is no information as to how many of the projects are executed and funded, whom the contractors handling the projects are and the extent of execution achieved. This again is another abuse on constituents right to know and creates room for diversion of funds or projects. It becomes a serious issue when viewed from the understanding that politics is about allocation of resources or who gets what? In this instance, the question all Politicians in Nkwerre/Nwangele/Isu/Njaba Federal Constituency should be asking is-out of over 16 billion naira worth of projects appropriated for Imo State from 2011 fiscal year to 2013 fiscal year, what did our Federal Constituency get? Simply put, what were our Federal Legislator and Federal Politicians alike able to bring to our constituency to improve our welfare and security? Where is our Federal Constituency’s oversight report for three years? The above questions brings to the fore, the reason for the 1999 constitution stating that the participation of the people in their government shall be ensured in accordance with the provisions of this Constitution (Section 14(2) (c)). If our Town Unions, interest groups and, politicians have been formed into project monitoring or Legislative support group, we would have actively participated by making contributions that will enable our Federal legislators represent us well. Unfortunately, our people have not understood that it is their constitutional right to participate in governance. Hence, the level of poverty, underdevelopment and abuse of our political, social, economic and fundamental human rights. CONCLUSION: In view of all the above, my candidacy for our Federal legislative seat is an exercise I have taken up to solicit support from our people to enable me restore their political, economic and social rights that are guaranteed by the constitution of the Federal Republic of Nigeria which they have lost over the years. It is my dream to ensure that the resources of the Federal Republic of Nigeria shall not be allocated in isolation of my constituency. It is my dream not to treat my people who voted me into power with disdain or ignominy to the point of denying them information that will empower them to participate and benefit from programs of the Federal Government. Mine shall be Legislator and Constituents Partnership for the development of Nkwerre/Nwangele/Isu/Njaba Federal Constituency.
