OndoTvLiked · 8 mins · Court backs PDP leadership dissolution of State Exco A Federal High court sitting in Abuja has ruled that the National Working Committee of the Peoples Democratic Party (PDP) has the constitutional right to dissolve its state executive. The judgement is the outcome of a case filed against the NWC by a faction of the Ondo PDP led by Ebenezer Alabi, following the dissolution of the state executives by the NWC after Governor Olusegun Mimiko rejoined the ruling party. The dissolution paved the way for the installation of a caretaker Committee headed by Dare Adeleke . Ruling on the case, Justice Ademola Adeniyi, who though admitted that the state executive has a four year life span, said however, that the constitution of the PDP allows for the dissolution of the state executive by the party’s leadership. Among others, the court also refused to grant the prayer of the plaintiff to restrain the leadership of the party from collecting names of aspirants in the coming elections in the state from any other body aside the plaintiff. The court also refused to grant any order against the Independent National Electoral Commission (INEC) in respect of any list submitted to it from the party other than those names put forward by the plaintiff. The trial judge, Justice Adeniyi Ademola fixed judgment in the matter, after taking arguments from all parties to the suit. Plaintiffs in the suit are contesting the powers of the party’s leadership to dissolve their executives constituted in 2012. Defendants in the suit include Dare Adeleke, Osawu Solomon, the PDP, its National Chairman, Adamu Mu’azu, the party’s National Secretary, Professor Wale Oladapo, Independent National Electoral Commission, INEC, and the Inspector General of Police, IGP. The PDP had entered a preliminary objection to the hearing of the suit. During hearing in the matter, Dr Onyechi Ikpeazu (SAN), counsel to the PDP and two others, argued that the suit was premature, not justifiable and defective. — the true court content are attached as follow.
