TRIAL UPDATE We started our second trial against the former Fairfield Nursing and Rehabilitation, Aurora Cares d/b/a Tara Cares, Aurora Healthcare, DTD, HC, LLC and D & N, LLC on behalf of our client Myrtis Hill on June 9, 2014 in the Circuit Court of Jefferson County, Bessemer Division. The case was tried for five straight days and after two full days of deliberation the jury was deadlocked. After polling the jury, ten (10) jurors favored us; the Plaintiffs and two (2) jurors favored the Defendants. Because the jury deadlocked, a hung jury was declared by the Court, and it looks like we will be trying the case yet a third time. We will gladly try this case again for our client and the protection of the community. While the Defendants tried to make this case simply about a broken leg, we explained to the jury it was about much more. It was about a system failure, a culture of revenue over nursing home residents that started from the top of these vertically integrated companies and had a direct impact on the facility, which caused and contributed to our client’s injury.
