Reemployment Assistance for Federal Workers during the Government Shutdown Federal workers affected by the government shutdown are unemployed and entitled to file claims for reemployment assistance (RA) benefits. While the shutdown may be short in its duration these impacted workers are not considered to be on a temporary layoff since they have no definite date to return to work. Federal workers will be required to complete the initial skills review and register for work within Employ Florida Marketplace in order to meet the reporting requirements of the law. They may be requested to provide DEO with a payroll record (check stub or pay receipt) or a copy of their 2012 W-2 in order for the RA program staff to calculate the benefits that can be paid on their claims. This is because the electronic exchange of wage data with some federal agencies may not be available since federal workers operating these systems are also subject to lay off. Unless the affected federal worker has previously filed an RA claim within the last 12 months the individual cannot be paid benefits until a waiting week has been served. This is the first week of total or partial unemployment following the filing date of the claim. For most federal workers the week ending October 5, which is the first week of the shutdown, will be a week of partial unemployment since they will have earned less than their weekly benefit amount. Credit for the waiting week cannot be given until the claim has been filed. The effective date of a claim is the Sunday preceding the filing date. Therefore, affected federal workers should be advised to file their claims as soon as possible. A federal worker who files a claim on or after October 6 will not be able to receive waiting week credit for the week ending October 5, which is the week that the layoff occurred. If the federal workers receive back pay when they return to work for the weeks they were unemployed as a result of the shutdown, they will be considered to have been employed for the affected weeks and will be considered overpaid on their claims. It will not be known whether back pay will be awarded to these federal workers until Congress and the president agree on the budget or a continuing resolution.
