That the Violation of Cost Laws as mentions in Clause no. 4.21.8 of draft Writ PIL application which is now under consideration of Appropriate Authorities that is Dept. of Energy, Govt. of Odisha, OERC & Union Ministry of Power, Govt. of India, consequent upon the advice of Honble High Court Odisha is very much responsible for #Unsustainableelectricity in Odisha, which can be viewed as follows: 4.21.8 That in violation of Electricity Act-2003, NEP-2005 & NTP-2006, the electrical engineering has been allowed to perform the works of Cost, Commerce, revenue & tariff illegally, though the State of Odisha have huge number of Cost and Commerce professionals & Experts are waiting to get jobs. The carrying out of cost, commerce, revenue & tariff jobs/works of Odisha power sector by unexpertise electrical engineering not only violated the laws of commercial principles & professionalism but also encouraged corruption & poor performance, the result of which was that the inefficient costs were passed on to the cost pool so to raise the tariff of electricity to the level of unrealistic and unreasonable point. Therefore, the anti-professionalism attitude of power administration of Odisha is responsible for poor & unsustainable electricity in Odisha. This needs to state here that, just after independence of India, the federal Govt., felt the necessity, role & importance of Cost in determining & accounting of realistic & reasonable price so to cope up with sustainable development & passed Cost & works Accountant Act in the year 1959 in the august house of Parliament. Under the provisions of CWA Act-1959, a Council was formed namely ICWAI (Institute of Cost & Works Accountants of India) now renamed as ICAI (Institute of Cost Accountants of India) by an amendment in the year 2012 to the CWA Act-1959. The detail functions of the Council of ICAI have been mentioned in Sec. 15 of the Act. Besides other functions, it approves academic courses & their contents for conducting examinations of Candidates for enrollment as Members. A Member of the Institute is called a “Cost & Management Accountant” (CMA) who is certified by the Council to perform cost works of different entities. This Council is functioning under the administrative control of Union Ministry of Corporate Affairs, Govt. of India.
