The Bill Maher thread has got me thinking about how right wingers try to get around laws, like the 1st Amendment, toward a goal of making clearly unconstitutional law, like a mandated religious establishment. What makes the work of many of these right wingers so insidious is that its arguments arise from deep studies of the law, so those particular right wingers actually know better than to claim that those arguments represent what they claim should be constitutional law.
