The Federal Court supports Islamic Family Law arbitration in Canada For Immediate Release Calgary, AB – The Honourable Madam Justice Simpson, the Federal Court of Canada, determined that the claims in an action to protect the rights of arbitration using Islamic and Sharia Laws in Canada is not frivolous, vexatious or abuse of the Court. On Nov 10, 2014, the Federal court dismissed the motion of Mrs. Raymond Wong of Field LLP and Waldemar A. Igras of Waldemar A. Igras Professional Corporation to strike the federal registration of IFL IGRAS Family Law ltd, and the trademarks IGRAS Family Law in Canada. The motion also asked to strike the Claims against the Alberta Law Society (ALS) and Alberta Law Insurance Association (ALIA) for unauthorized use and marketing of a registered trademarks “IGRAS Family Law” and the corporate identity “IFL IGRAS Family Law”. The historical decision allows IFL IGRAS Family Law ltd to continue to protect its identity from a lawyer abuse. In the Federal Court, IFL IGRAS Family Law ltd. initiated an action to stop a Lawyer, Alberta Law Society (ALS) and Alberta Law Insurance Association (ALIA) from impersonate and unlawful use of trademarks “IGRAS Family Law” and the corporate identity “IFL IGRAS Family Law” without authorization, registration or permit. The action filed in the Federal Court demonstrates a case of a lawyer abusing the law. An active member of the Alberta Law Society markets through the society a legal firm without proper registration, incorporation or permit to offer legal services. He is using the trademarks of IFL IGRAS Family Law Ltd without authorization to offset his liability and pass-off the registered trademarks. In Canada, a business has to be legally registered and to obtain the proper permits. The Legal Profession Acts limits a law firm offering legal services to be legally registered with special incorporation articles and to continue to be a in a good standing with a business registration agency in Canada. The history of the Action is as follows: May 26, 2014: a court claim has been filed in the Federal Court of Canada, to restrain Mr. Waldemar A. Igras and Waldemar A. Igras Professional Corporation from using “IGRAS Family Law” and “IFL IGRAS Family Law”, which are registered in Canada. The action was filed after the Alberta Law Society denied a complaint for the society intervention to stop a infringing trademarks rights. May 29, 2014: Mr. Raymond Wong of Field LLP received an order form Alberta Queen Bench to restrain IFL IGRAS Family Law ltd from marketing its services via a private communication with a Judge and without serve or presence of any party. The Queen Bench Court record shows that during the hearing, the judge orders to go-off record and the court switched off the recording for a frank discussion. June 23, 2014: Mr. Raymond Wong of Field LLP sent an objection letter to Corporations Canada for registering IFL IGRAS Family Law ltd, and the objection was denied for lack of merits. November 3, 2014: Roger Lafrenière, Esq., Prothonotary of the federal court, issued an order so the IFL IGRAS Family Law Ltd. can resume its online marketing activities under the Freedom of Expression. November 10, 2014: The Federal Court decision to allow IFL IGRAS Family Law ltd to fight for its rights and identity. Under Canadian Laws and Statutes, the Federal Court has the exclusive Jurisdiction of trademarks disputes. IFL IGRAS Family Law ltd. and its partners will not comment on the Judicial System or the way that Mrs. Raymond Wong and Waldemar Igras received orders from Judges via private communications outside Rules of Court and outside Jurisdictions. “In God we believe, in God we trust, God protects us and provides his guidance and blessing to protect our rights. Everyone is equal before and after Canadian Law and IFL IGRAS Family Law ltd. will not comment on matters pending before a Court or a Tribune till a decision is rendered, it is our code of conducts and we will stick to it. This order is a live demonstration of IFL IGRAS Family Law Ltd capabilities that continue to provide successful outcomes to our clients and partners within the limits of the law and we are confident in our ability to protect our Islamic identity” said Wael Badawy, Counsellor and Member of the International Arbitration Center. Once the order was rendered and announced, IFL IGRAS Family Law ltd. received an avalanche of messages from its fans, supporters and partners to celebrate the successful outcomes of the first appearance of an arbiter before the Federal Court. IFL IGRAS Family Law ltd saw the light at the end of the tunnel, with the order of Roger Lafrenière, Esq., Prothonotary, that enforced our Freedom of Expression.
