The Integrity Commission has referred a complaint against Calder Hart, former executive chairman of the Urban Development Corporation of Trinidad and Tobago (UDeCOTT), to the Director of Public Prosecutions (DPP), Roger Gaspard. Hart was informed by letter of the Integrity Commission’s decision on July 19. The Integrity Commission has stated there may have been an alleged breach by Hart of Section 29 of the Integrity in Public Life Act. The complaint stems from UDeCOTT’s decision to award a $367 million contract to build the Legal Affairs Ministry Tower in Port of Spain to CH Development to two men — Lee Hup Ming and Ng Chin Pow — who are the brother and brother-in-law of Hart’s wife, Sherrine Hart. Section 29 of the Integrity in Public Life Act reads: “(1) For the purposes of this Act, a conflict of interest is deemed to arise if a person in public life or any person exercising a public function were to make or participate in the making of a decision in the execution of his office and at the same time knows or ought reasonably to have known, that in the making of the decision, there is an opportunity either directly or indirectly to further his private interests or that of a member of his family or of any other person. (2) Where there is a possible or perceived conflict of interest, a person to whom this Part applies, shall disclose his interest in accordance with prescribed procedures and disqualify himself from any decision-making process.” Hart yesterday confirmed to the Express that the matter was referred to the DPP. trinidadexpress/news/Harts-file-goes-to-DPP-218312931.html
