The Land Acquisition Act The Land Acquisition Act of 1894 is the original articulation of the eminent domain concept by the Indian government. It specifies the procedures to be used and the personnel who must be involved in the transfer of land for public purposes. Among its many provisions, it appoints the Collector or Deputy Commissioner of the administrative district in question--there are more than 600 in India--as resposible for managing the transfer of property from one use to another. Additionally, the Act requires meticulous public notification through government organs, daily newspapers, and visible postings. This dictate allows interested parties, the land owners included, to voice their objections and alternatives. In reply, the district officials, or their designated representative, must likewise publicly assert how the land serves as an asset to the public interest.
