The Permissibility of Speaking While on the Toilet By Ash-Shaykh Al-Albaanee (may Allah have mercy upon him) It was reported from Jaabir bin Abdillah (may Allah be pleased with him) that a man passed by the Prophet (peace and blessings of Allah be upon him) while he was urinating, so the man gave the greeting of Salaam (peace) to him. The Messenger of Allah (peace and blessings of Allah be upon him) replied, If you see me in this condition (using the toilet) do not give the greeting of Salaam (peace) to me. For verily if you do that, I will not return the greeting to you. Grade: Saheeh (authentic). See As-Saheehah, #197. Point of benefit: I (Al-Albaanee) say that what is apparent from this hadeeth is that he (the Prophet) said that to the man while he was urinating. Thus, this contains a proof that it is permissible to speak while using the toilet, and the hadeeth that has been reported stating that Allah detests that, along with the fact that it is not authentic in reference to its chain of narrators, it is also not a clear prohibition of speaking (while using the toilet). For verily its wording states, Two people should not hold a conversation while they are defecating, with each one of them looking at the privates of his companion. For verily Allah detests that. Then I came across another route of narrators for it and I presented it in the seventh volume, number 3120. Therefore, this text only proves the forbiddance of this situation, and it is that people speak while looking at each others private body parts (while using the toilet). It does not contain a proof that speaking while using the restroom only - even though it is in itself something disliked - is from that which Allah detests, blessed be He the Most High. Rather, that would be something that must have an evidence to show that it is forbidden, and that is something that we do not find existing. However, looking at another persons private parts is certainly forbidden, for verily its prohibition is confirmed in more than just one hadeeth.
